Former Cherngtalay OrBorTor chief sentenced to 2 years’ imprisonment

…with no chance for bail.

The former OrBorTor for the Phuket sub-district of Cherng Talay has been sentenced to 2 years’ imprisonment on corruption charges. According to a Phuket News report, the high-profile MaAnn Samran was found guilty of “improperly selecting and appointing” administrators.

His sentencing, which was handed down by the Criminal Court for Corruption and Misconduct, carries no option of parole. The court found MaAnn guilty of unlawfully choosing employees from his office and promoting them to more senior, high-level positions.

MaAnn was found guilty under a number of anti-corruption laws, including Section 157 of the Criminal Code, which states:

“Whoever, being an official, wrongfully exercises or does not exercise any of his functions to the injury of any person, or dishonestly exercises or omits to exercise any of his functions, shall be punished with imprisonment of 1 to 10 years or to a fine of 20,000 to 200,000 baht or both.”

MaAnn’s sentencing was announced by the National Anti-Corruption Commission, while acknowledging that he has the right to appeal.

The former OrBorTor is also at the centre of another corruption investigation related to the construction of the New Nordic Phuket Water World project near Bangtao Beach.

In that case, the NACC has accused MaAnn and 3 other officials of providing illegal and forged paperwork to allow the construction to go ahead. The findings of that investigation are not yet known.
